1. User Generated Content

The following terms should be read alongside NAK’s Privacy Policy. These terms are subject to change from time to time without notice. These terms apply to your use of the NAK website (nakhair.com.au) and associated social media pages (including, but not limited to, NAK’s Facebook, Instagram and TikTok sites) (NAK Sites).

User-Generated Content means any text, audio, photograph and/or video submitted by you to any NAK Sites (Content). This may include:

Written testimonials; Content uploaded to NAK Sites and tagged with an official NAK social media handle or hashtag; and/or Responses in the comment section of any NAK Sites. If you produce any Content, you give NAK permission to use, reproduce, modify, and publish in any medium any Content you provide. We are and shall be under no obligation to maintain any Content in confidence or pay compensation for any Content.

NAK does not claim ownership rights in any Content.

Competition period commences on Wednesday 10 July 2024 at 12:01AM AEST.

Entries will be open for Entrants throughout the Competition Period. The Promoter reserves the right to tease the promotion prior to the Competition start date.

7. Competition Period Close Date & Time

Competition concludes on Thursday 1 August 2024 at 11:59PM AEST.

The Promoter reserves the right to terminate the Competition subject to any direction from a regulatory authority.

8. Entry Restrictions

Entrants must be 18 years of age or over at the time of entry;
Entrants must be Australian residents and have a registered address in Australia;
Competition is not open to any person, including Australian residents, entering the Competition from outside of Australia;
Entrants may enter only once. Only one (1) prize can be won;
Entrants acknowledge that they must be contactable by the Promoter to be successful. Entrants unable to be contacted in accordance with these terms for any reason will forfeit their prize/opportunity;
Entrants who provide incorrect, misleading or fraudulent information are ineligible in the Competition and all entries of an Entrant who is deemed by the Promoter to have provided incorrect or misleading information may, at the discretion of the Promoter, be deemed invalid;
Entrants may be asked to provide a nominated valid postal address and email address as requested by the Promoter, at the Promoter’s discretion;
By submitting an entry, the Entrant acknowledges and agrees to be bound by these Terms and Conditions;
Entries can only be made in an individual’s own capacity and no entry can be made for or on behalf of any other person, venture or organisation;
Competition is not open to:
Employees of, or contractors to, the Promoter or any of its agencies involved with the Promotion; or
Spouse, de facto spouse, parent, natural or adopted child, or sibling (whether natural or adopted by a parent) of such employees and contractors (whether or not they live in the same household).
Redeeming the Prize and any tickets, passes or vouchers issued as part of the Prize is conditional on acceptance of terms and conditions as detailed by the Promoter, any prize providers and the airline carriers in accordance with normal travel practices.
All Entrants acknowledge and agree that the Promoter can rely on these Terms and Conditions, in particular if the Promoter only learns of an Entrant’s ineligibility after the Promoter has or appears to have awarded the prize to the ineligible Entrant. In those circumstances, the Promoter can require return of the prize or payment of its value to the Promoter.
If the Prize includes any travel, the following terms and conditions will also apply (where applicable):
Blackout period: If the Prize includes international or domestic travel, the Prize cannot be taken during peak periods or any travel ‘blackout’ periods applying which will be specified by the Promoter or applicable prize provider and must be booked and completed as specified by the Promoter and/or the prize provider or organiser of the Prize.
Travel dates: All travel must be taken or completed by any dates specified by the Promoter and/or prize supplier and is subject to availability. If the Prize is event based, travel must be taken to coincide with the relevant event on the dates specified by the Promoter.
Travel and accommodation are subject to availability. Any travel and accommodation constituting part of a Prize (if applicable) are subject to booking availability, availability of select seat class with airlines or specific room category availability with accommodation partner. All costs associated with a travel Prize which are not specified to be included in the Prize, including but not limited to any transfer costs (including transport to and from the airport), meals, taxes, insurance and all other ancillary costs, are the responsibility of the Winner and their companion/s (if applicable).
Travel insurance, visas and vaccinations: The winner and any travelling companions (if applicable) are responsible for obtaining all necessary valid travel insurance, documents to travel to the relevant country (including a current passport and visas, if required) and any vaccinations. The winner should consult the Embassy or Consulate of that jurisdiction for up-to-date information to ensure they can obtain the required visa prior to travel, in order to accept the Prize. If the winner and/or their companion is unable to obtain a relevant visa or travel document, and/or is refused entry into the relevant country, the winner may forfeit the Prize, in the sole and absolute discretion of the Promoter.
Cancellation, changes, delays, rescheduling etc: The Promoter is not responsible for any cancellation, changes, delay or rescheduling of events, travel, activities and flights and any costs incurred as a result (including, without limitation, accommodation costs) will be the sole responsibility of the winner and their companions. In the event that one or more event or activity is no longer available, the remainder of the prize shall constitute the complete and total Prize.
Organising travel and transfers: Unless otherwise specified in the Prize section above, it is the winner's responsibility to organise transport to/from the airport departure/return point.

9. How to enter

During the Competition Period, for each Valid Entry:

Entrants must complete the NAK Hair Salon Survey, completing all required fields including name and email address.

10. Limitation on entries

Entrants may only enter once into the Competition. Winner will only win one (1) prize.

11. Prize Draw

Each Valid Entry submitted in the above specified Competition Period will go into the draw to win the prize.

The Winner will be drawn from the list of valid entries via computerised random selection.

The draw will take place on Friday 2 August 2024 at 4:00PM AEST at 7 Eagleview Place, Eagle Farm QLD 4009 Australia.

12. Prize Details

There is one (1) Prize to be won for one (1) winner.

Prize is an AUD$500 NAK Hair voucher.

There will be one winner per prize.

The Prize must be accepted as awarded and is not transferable or otherwise redeemable for cash and cannot be taken in parts. The Prize is valid until the expiry date specified on the voucher or by the voucher provider. The Promoter will not be responsible for any voucher that is lost or stolen.

13. Total Prize Value

Total prize pool value of AUD$500.

14. Winner Notification

Prize Winner will be notified via email if they have been successful in winning the Prize within seven business days of the Prize Draw Date of Friday 2 August 2024.

The Promoter will publish on their website the initial of the first name, last name and postcode of the Winner within 30 days of the draw.

15. Prize Claim and Delivery

Prize must be claimed by 4:00PM AEST on Monday 30 September 2024. Prize will be delivered, pair or transferred to the Winner within 13 days after the Prize has been claimed. Any unclaimed prizes will be forfeited, and the prize will be re-drawn.

Winner may be required to prove their identity and show evidence as documented on their birth certificate, driver’s licence or passport before any prize is rewarded.

Winner may also be required to provide any documentation which the Promoter and/or the Promoter’s insurer reasonably requests for the purposes of prize redemption.

If the Prize has been arranged for a certain time / date, then the Winner must be available to take this as specified by the Promoter. If the Winner is unable to facilitate this, then they may be required to forfeit the Prize.

The Promoter will not be liable for prizes that are damaged or lost in the mail or not delivered to the winner due to external circumstances outside of the Promoter’s control. No compensation or replacement prizes will be offered.

Prizes may be provided to the Winner by the Promoter or the Prize Provider and will be delivered to the Winner’s residential address via mail and delivered via email.

Where the prize is a physical products or gift card:

Mail & Email - The prizes may be provided to the Winner by the Provider and can be delivered to the Winner’s residential address via mail or delivered via email.

Where the prize is travel

Verification requirement – The prize must be claimed by the Winner providing the Promoter the full names and contact details of the travellers as per a valid form of identification.

16. Prize Claim Date and Time & Unclaimed Prize Draw

Prize must be claimed by 4:00PM AEST on Monday 30 September 2024. If a Winner does not claim their prize(s) within the specified period, they will forfeit their prize.

Unclaimed Prize Draw

A re-draw will then take on Tuesday 1 October 2024 at 4:00PM AEST at 7 Eagleview Place, Eagle Farm QLD 4009 Australia.

The Winner of the redraw will be drawn at random from the list of valid entries via computerised random selection. The Winner will be notified via email if they have been successful in winning the Prize within seven business days of the Unclaimed Prize Draw date. The Unclaimed Prize Draw winners will have until 4:00PM AEST on Tuesday 29 October 2024 to claim the prize.

17. Special conditions

General

The Promoter’s decision is final and no correspondence will be entered into regarding the award of any prize or the pronouncement of a Winner/s (as applicable).

Prizes awarded are subject to availability and are at the complete discretion of the Promoter.

Should any elements of the prize be changed, moved, cancelled or not available for any unforeseen reason or for reasons outside of the Promoter’s control (including, for example, COVID-19), the Promoter takes no responsibility, and the Winner/s will not be compensated.

Prior to acceptance of any prize, the Promoter may require the Winner to sign documents including a prize acceptance form. Any Winner that fails to sign any required documentation as requested by the Promoter may be disqualified from the promotion.

Should there be any technical malfunctions for any reason, the Promoter has the option to extend the time period for giveaways and/or change the specified day subject to regulatory approval. The Promoter will then stipulate on online or on social the new end time of the competition.

Information collected

Entrants’ personal information will be collected by the Promoter. Personal information about an entrant is collected to include the entrant in the competition and where appropriate award the prize(s). If the personal information requested is not provided, the entrant cannot participate in the competition. By participating in the competition, an entrant also acknowledges that a further primary purpose for collection of the entrant’s personal information is to enable the Promoter to use the information for future marketing purposes regarding their products, including contacting the entrant electronically. The Promoter may share information with their Australian related companies or promotional partners who may contact the entrant with special offers in this way. By entering the competition, an entrant agrees that the Promoter may use the entrant’s personal information in the manner set out in this condition.  An entrant also agrees that the Promoter may publish or cause to be published the winner’s name and locality in any media as required under the relevant State or Territory lottery legislation.  Entrants can also gain access to, update or correct any personal information by contacting the Promoter at info@nakhair.com.au.  All personal information will be stored on the Promoter’s database. 10. Limitation on Entries

Entrants may enter the Competition as many times as they wish, however only one (1) Major Prize and two (2) Minor Prizes can be won.

11. Prize Draw

Each valid entry submitted in the above specified Competition Period will go into the draw to win the prizes. The winners will be chosen from the list of valid entries based on creativity, technique, and content skills. The draw will take place at NAK Hair Head Office, 7 Eagleview Place, Eagle Farm, Queensland on Monday 16 December 2024 at 9:00am AEST.

12. Prize Details:

There is one (1) Major Prize to be won:

Salon Winner: 1 x AU$500 Visa Gift Card;

Stylist Winner: 1 x AU$500 Adore Beauty Gift Card.

There are two (2) Minor Prizes to be won:

Salon Winner: 1 x AU$100 Visa Gift Card;

Stylist Winner: 1 x AU$100 Adore Beauty Gift Card.

The Prize must be accepted as awarded and is not transferable or otherwise redeemable for cash and cannot be taken in parts. The odds of winning the prize depend on the number of eligible entries received.

The total Major Prize pool minimum value is AU$1,000. The total Minor Prize pool minimum value is 2 x AU$200.

13. Winner Notification

The winners will be notified if they have been successful in winning a prize within one (1) day of the Competition Draw Date of Monday 16 December 2024 at 9:00am AEST.

The winner will be notified via direct message from @nakhair on Instagram.

The Promoter may publish the initial of the first name, last name and postcode of the winners within 30 days of the draw on the Instagram post.

The Promoter also has the option to extend the existing contesting day should it be required for any reason.

12. Prize Details:

There is three (3) Major Prize to be won: Each Prize includes a ROH PR Box (minimum value AUD$322 each – Recommended Retail Price).

The Prize must be accepted as awarded and is not transferable or otherwise redeemable for cash and cannot be taken in parts. The odds of winning the prize depend on the number of eligible entries received.

13. Winner Notification

The winners will be notified if they have been successful in winning a prize within one (1) day of the Competition Draw Date of Monday 25 November 2024 at 9:00am AEST.

The winner will be notified via direct message from @roh.australia on Instagram.

The Promoter may publish the initial of the first name, last name and postcode of the winners within 30 days of the draw on the Instagram post.

14. Prize Claim & Delivery

Prizes must be claimed by 17:00PM AEST on Wednesday 27 November 2024. Any unclaimed prizes will be forfeited, and the prize will be re-drawn.
